1) Acceptance of Terms

Welcome to the websites, content, programs, and services of Testimony Publishers, LLC.® (“TP,” “we,” “us,” “our”). These Terms of Use (the “Terms” or “Agreement”) govern your access to and use of all TP online properties, products, events, and services, including without limitation www.testimonypublishersllc.com and any related or successor domains, subdomains, landing pages, membership portals, and communities (collectively, the “Sites”), as well as in-person and virtual programs (the “Services”).
By accessing or using the Sites/Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Sites/Services.

2) Eligibility; Accounts

• You must be 18 years or older to use the Sites/Services.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3) Informational/Educational Use Only; No Professional Advice

All content, coaching, courses, workshops, retreats, masterclasses, strategy sessions, books, audios/videos, meditations, visualizations, and any “vibration/energy work” provided by TP, A.C. Johnson, and Christina M. Johnson (collectively, the “TP Representatives”) are educational and informational in nature. We do not provide medical, psychological, legal, tax, financial, or therapeutic advice and no content should be relied upon as such. Always consult your licensed professional(s) before acting on information found on the Sites/Services.

4) Results, Earnings & Testimonials Disclaimer

• Individual results vary. We do not guarantee results, outcomes, income, or earnings.
• Any case studies or testimonials reflect the experiences of specific clients and are not typical or a promise of performance.
• Your results depend on many factors outside our control, including your commitment, skills, resources, market conditions, and ability to follow directions.

5) Health & Well-Being; Energy/Spiritual Modalities

Certain methods may involve focusing on past experiences or emotional material and can evoke discomfort. Do not use any technique that makes you feel unsafe. If you experience distress, stop and seek appropriate care. TP and TP Representatives are not psychotherapists or medical providers; our offerings are not a diagnosis, treatment, cure, or prevention for any condition and are intended only to support personal growth.

6) Client Responsibilities & Consent to Participate

You are solely responsible for your choices, actions, and outcomes before, during, and after any TP Service. You agree to:

• Provide accurate information when registering or engaging with TP.
• Disclose any health/well-being concerns that may impact participation.
• Inform your other coaches/therapists/providers of your participation with TP where appropriate.
• Decide at all times whether to participate or abstain from any activity.

7) Intellectual Property & License

All content on the Sites/Services—including text, videos, audios, images, graphics, logos, software, workbooks, frameworks, course materials, and downloads—is owned or licensed by TP and protected by IP laws.
You may not record, copy, reproduce, modify, translate, publish, distribute, publicly display/perform, create derivative works from, sell, license, rent, or exploit any content without TP’s prior written consent. Limited personal, non-transferable access is granted solely for your individual use per the specific product/service license.

8) User Content; Live Session & Event Recordings

• If you submit content (e.g., comments, posts, submissions, voice/video participation), you represent you own or have rights to it and grant TP a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, and display it to operate, promote, and improve the Sites/Services.
• Group calls, classes, or events may be recorded for participant replay, internal quality, and promotional purposes. We capture only those participants who consent; you may disable your camera/mic or opt out by notifying us in advance.
• Do not submit confidential or proprietary information you wish to keep private.

9) Prohibited Conduct

You agree not to:

• Violate any law or third-party rights (privacy, IP, publicity).
• Upload malicious code or attempt to disrupt systems.
• Harass, abuse, defame, or threaten others.
• Scrape, mine, or use automated means without permission.
• Circumvent access controls, paywalls, or DRM.

10) Purchases, Subscriptions, & Payment Policies

• Prices, features, and availability are subject to change.
• You authorize TP (and our payment processors) to charge your payment method for purchases, subscriptions, or payment plans, including recurring charges until you cancel per the product’s stated terms.
• Chargebacks: You agree not to file chargebacks without first contacting TP support to resolve issues; unjustified chargebacks may be sent to collections.
• Refunds/Cancellations: Unless a specific product page states a written refund policy, all sales are final. If a product includes a guarantee, the specific guarantee terms on the checkout page govern.

11) Shipping & Digital Delivery (If Applicable)

Physical products ship to the address you provide; shipping times are estimates only. Risk of loss passes on delivery to the carrier. Digital products are delivered via download links/member portal access.

12) Community Rules (e.g., Self-Publishers Hub, private groups)

Be respectful. No spamming, self-promotion outside designated areas, or sharing of paid materials. We may moderate, remove posts, or terminate access for violations.

13) Third-Party Services & Links

The Sites/Services may link to or integrate third-party tools (e.g., payment processors, analytics, email, advertising). We are not responsible for those services or their policies. Review their terms and privacy practices before use.

14) Messaging Terms & Conditions (TCPA/CTA Compliance)

• Consent is not a condition of purchase.
• Message frequency varies; message & data rates may apply.

15) Privacy

Your use of the Sites/Services is subject to our Privacy Policy, which explains what we collect, how we use it, and your rights (including cookies/analytics/marketing tools and opt-out choices).

16) Testimonials, Endorsements & Affiliate Disclosure

We may publish client testimonials and case studies. They are individual opinions and experiences, provided with consent where required, and may be edited for length/clarity. We may receive affiliate compensation if you purchase through certain links; we only recommend resources we believe add value.

17) Legal Compliance; Cooperation with Authorities

We may restrict access, suspend, or terminate use if we believe you violated these Terms or applicable law. We may disclose information to law enforcement or regulators if legally required (e.g., subpoena, court order).

18) DMCA Notice (Copyright)

If you believe your copyrighted work was used on the Sites/Services without authorization, send a DMCA notice including: (a) your signature, (b) identification of the work, (c) identification of the infringing material, (d) your contact info, (e) a good-faith statement, and (f) a perjury statement.

19) Warranties Disclaimed

The Sites/Services and all content are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted, error-free, or secure access.

20) Limitation of Liability

To the maximum extent permitted by law, TP, the TP Representatives, affiliates, licensors, and partners are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages; lost profits; data loss; business interruption; or reputational harm arising from or related to your use of (or inability to use) the Sites/Services—even if advised of the possibility. In no event will our aggregate liability exceed the amount you paid to TP in the three (3) months preceding the claim (or $100, if greater).

21) Indemnification

You agree to defend, indemnify, and hold harmless TP, the TP Representatives, affiliates, licensors, and partners from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your: (a) use of the Sites/Services, (b) user content, (c) violation of these Terms, or (d) violation of any law or third-party right.

22) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, acts of God, outages, strikes, war, terrorism, government action).

23) Governing Law; Dispute Resolution; Class Action Waiver

• Governing Law: These Terms are governed by the laws of the State of Wyoming, without regard to conflicts principles.
• Informal Resolution: You agree to first attempt to resolve disputes informally by contacting us at admin@testimonypublishersllc.com within 30 days of the issue.
• Arbitration: If we cannot resolve informally, disputes will be resolved by binding arbitration before a single arbitrator under the AAA Commercial Arbitration Rules in Natrona County, Wyoming, or by video. You waive the right to a jury trial.
• Class/Collective Actions: You agree disputes will be handled only on an individual basis, and not as a class, collective, or representative action.

24) Changes to Terms

We may update these Terms at any time. The “Effective Date” above reflects the latest revision. Your continued use after changes are posted constitutes acceptance of the updated Terms.

25) Severability; Assignment; Entire Agreement

If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without our consent; we may assign to an affiliate or successor. These Terms, together with the Privacy Policy and any product-specific terms at checkout, constitute the entire agreement between you and TP.
